Terms of Service

Effective Date: January 1, 2026

Agreement to Terms

These Terms of Service govern all services provided by Surniy Logistics Group LLC, including freight transportation, delivery, warehousing, and logistics coordination. By submitting a shipment request, you acknowledge and agree to these terms.

Service Eligibility

• Services are available to businesses and individuals 18 years of age or older.
• You must provide accurate and complete information when booking a shipment.
• Surniy Logistics Group LLC reserves the right to refuse service at our discretion.
• Prohibited items include hazardous materials (without prior written approval), illegal substances, and live animals.

Client Responsibilities

• Properly package and label all cargo before pickup.
• Accurately declare the contents, weight, and declared value of all shipments.
• Ensure someone is available at the pickup and delivery locations at the scheduled time.
• Provide accurate delivery addresses and recipient contact information.

Delivery Rules

• Estimated delivery times are not guaranteed but are provided in good faith based on standard transit routes.
• Surniy Logistics Group LLC is not liable for delays caused by weather, road closures, accidents, government actions, or other force majeure events.
• Failed delivery attempts due to recipient unavailability may result in additional fees.

Governing Law

These Terms shall be governed by the laws of the State of Texas. Any disputes shall be subject to the exclusive jurisdiction of the courts of Harris County, Texas. These Terms may be updated with 30 days' notice to active clients.

Shipping & Delivery Policy

Effective Date: January 1, 2026

Delivery Timelines

• Same-Day Delivery: Available within the Houston/Katy metro area for orders booked before 10AM CT.
• Local Delivery (Texas): 1–2 business days for most Texas destinations.
• Regional Freight (South/Southwest): 2–4 business days depending on distance and route.
• Long-Distance / Cross-Country: 4–10 business days depending on origin, destination, and service type.

All timelines are estimates and begin from the confirmed pickup date. A tracking number is issued upon dispatch so you can monitor progress in real time.

Service Areas

• Primary service area: Houston/Katy metro and all of Texas.
• Extended service area: All 48 continental United States via our carrier network.
• International shipments are not currently offered.

Weather & Delays

• Surniy Logistics Group LLC is not liable for delays caused by severe weather, natural disasters, road closures, or other force majeure conditions.
• We will notify customers of delays as soon as we become aware and provide a revised estimated delivery time.
• Customers may contact our 24/7 dispatch at 1-800-829-4933 for real-time delay updates.

Damaged or Lost Goods Process

• All damage or loss claims must be filed in writing within 7 days of the scheduled delivery date.
• Customers must provide photos of damaged goods and original packaging when filing a claim.
• Claims are reviewed within 15 business days of submission.
• Compensation is limited to the declared value of the shipment and the terms of our cargo insurance policy.
• Surniy Logistics is not liable for damage to improperly packaged items or goods with pre-existing damage.

Special Cargo Requirements

• Temperature-sensitive or refrigerated cargo requires advance notice and may carry additional fees.
• Oversized or overweight freight requires a custom quote before booking.
• Hazardous materials require prior written approval and full regulatory documentation (MSDS sheets, UN classification, etc.).

Refund & Cancellation Policy

Effective Date: January 1, 2026

Cancellation Fees

• 48+ hours before pickup: Free cancellation — no charge.
• 24–48 hours before pickup: 25% cancellation fee of the quoted rate.
• Less than 24 hours before pickup: 50% cancellation fee of the quoted rate.
• No-show / Refused pickup: Billed at 100% of the agreed rate.
• No-show / Refused delivery: Billed at 100% of the agreed rate plus any return freight costs.

Rescheduling

• Rescheduling requests must be submitted at least 24 hours before the scheduled pickup.
• One complimentary reschedule is available per shipment for requests made 48+ hours in advance.
• Subsequent reschedule requests may be subject to an administrative fee.

Refund Process

• Approved refunds are processed within 10–15 business days via the original payment method.
• Refunds will not be issued for services that have already been rendered or are in transit.

Force Majeure

Cancellations caused by severe weather, natural disasters, government orders, or other force majeure events are not subject to cancellation fees. We will work with affected customers to reschedule at no additional cost.

Liability & Insurance Policy

Effective Date: January 1, 2026

Standard Coverage

• Standard cargo liability coverage is included on all shipments at no additional cost.
• Coverage is based on the declared value provided at time of booking.
• If no declared value is provided, maximum liability defaults to $0.50 per pound.

Additional Insurance

• Additional insurance for high-value goods (over $10,000) can be arranged upon request before booking.
• Additional insurance premiums will be disclosed and added to your quote.

Claims Process

• Claims must be submitted in writing within 7 days of delivery or the scheduled delivery date.
• Required documentation: photos of damage, original packaging, Bill of Lading, and invoice.
• Claims are reviewed and responded to within 15 business days.
• Approved claim payments are processed within 30 days of approval.

Exclusions

• We are not liable for damage to improperly packaged goods.
• We are not liable for pre-existing damage or goods damaged due to their inherent nature.
• We are not liable for delays, losses, or damage caused by force majeure events.
• We are not liable for indirect, consequential, or punitive damages.

Payment & Billing Policy

Effective Date: January 1, 2026

Quoting & Pricing

• All quotes are provided free of charge with no obligation.
• Quotes are valid for 7 days from the date of issue.
• Final rates are confirmed in writing before dispatch.
• Fuel surcharges may apply and will always be disclosed at time of quoting.
• Rates for oversized, overweight, or special-handling cargo are quoted individually.

Payment Terms

• Payment is due within 30 days of invoice date unless otherwise agreed in writing.
• New clients may be required to pay 50% upfront before dispatch.
• Established clients may qualify for Net-30 or Net-60 terms on written application.

Accepted Payment Methods

• ACH bank transfer (preferred)
• Business check (allow 3–5 days for clearance)
• Major credit cards (Visa, Mastercard, Amex)
• Zelle / Wire transfer for large accounts

Late Payments

• Invoices unpaid after 30 days are subject to a 1.5% monthly late fee.
• Accounts with outstanding balances over 60 days may have service suspended.
• Disputed invoices must be raised in writing within 10 days of receipt.
